This sequence of text "3" into chart is only in the INF column, therefore you have always look exact, to which unit type this additional text apply.
As Empecinado says, it applys only to INF.
ART never get an penalty, whether uphill, no downhill and no hill to hill ;)

In this example the French artillery does not have LOS of either British unit.
The hill blocks LOS on the line unit;
the line unit blocks LOS on the rifle unit.
If the line unit was absent, then the artillery could fire on the rifle unit.
This is an unusual situation in which the line unit cannot be fired upon and at the same time blocks LOS. Kind of strange, but those are the rules.

those are the rules.

If it really bothers you you could have a variant that units that are out of LOS of either firer or target do not block LOS between two those units.

LOL - A strange anomaly. I say strange because in 60 games I've played I've yet to come across it and yet as shown here, it looks as if it could easily occur. Thanks for showing that. Maybe Mark's soloution is not only a good one but should be forwarded to Mr Borg as a rule required for insert into the official rules. Now you've shown this, I bet it happens on my table in the very next game.

In my mind, it´s always better to have one rule less than one more.
So accept some rules, for easy playability, also if you have sometimes curious, abstract and maybe not understandable situations/rules.

I don´t want a final result, as we have it in meantime in Memoir 44, hundreds (small, but a lot) rules and a big FAQ, which is opposing to the easy and
fast gameplay, which the CC-System should be. And all my MM44 friends (and there are some expert players, who plays only MM44 and dozen of games each day),
agree, that they can´t remember all the rules/FAQs in meantime.

So i my choice is clear because of the (still) easy gameplay of CCN. Accept in such situations the curious rules as we have it and wish,
we don´t get much more rules/FAQ to remember in future :S

I canceled MM44 gaming because of exact this cirumstance and i hope, i must not cancel CCN because of the same reason in future :unsure:

it can only ever matter for artillery fire, so I don't really think it is a major problem.

I agree, I've never seen it happen in a game I've played yet. Certainly not a 'major' problem or problem at all. Just an anomaly.

My brother and I came across this situation in one of our games. We hesitated for a moment and then just applied the rules as given; no problem here; we like to keep it simple and fair. I Just thought I would share it with all the C&CN aficionados because it is an unusual situation.

Sometimes we were not sure of certain "line of sight" situations, as it is sometime tough to just eyeball, so my brother mapped a number of situation out on a hex grid. Here's a picture of his product.
